By creating an account, subscribing to Fishpond, or otherwise using the Fishpond.ie platform, you agree to these Terms and Conditions. Please also read our Privacy Policy, Cookies Policy, and Accessibility Policy, which form part of your agreement with us.

These Terms apply to all users of Fishpond, including actors (and parents or guardians managing child performer accounts) and industry users (casting professionals, agents, producers, and other industry members). Section 14 sets out additional terms that apply specifically to industry users.

These Terms do not affect your statutory rights under Irish and EU consumer law.

1. About Fishpond

Fishpond.ie is operated by Fishpond Ltd, registered in Dublin, Ireland (Company Registration Number 333340), with a registered address in Ranelagh, Dublin 6. Fishpond is a casting platform connecting actors with casting professionals and industry users.

In these Terms, “Fishpond,” “we,” “us,” and “our” refer to Fishpond Ltd. “You” and “your” refer to the member or user agreeing to these Terms.

2. Membership Eligibility

Adult actors (18 and over). Adult actors must have some professional credits, formal training, or demonstrable acting experience to be eligible for membership.

Child actors (under 18). Child actors do not require professional credits or training, only a genuine interest in acting. Child accounts must be created and managed by a parent or legal guardian (see section 9).

We assess eligibility fairly and consistently. We reserve the right to refuse or remove profiles that do not meet the eligibility criteria or that contain false, misleading, or inappropriate information. Where we refuse a profile, we will explain our reasons and where possible suggest how the issue might be resolved.

3. Your Profile

Profile content limits. Actors on a paid subscription may upload up to five photographs, five videos, and five voice clips. Actors who are not on a paid subscription may upload up to one photograph, one video, and one voice clip. Fishpond reserves the right to amend profile limits and platform features.

Accuracy. You are responsible for ensuring that the information in your profile is accurate and kept up to date. Misleading or false information may result in suspension or removal of your account.

Profile visibility. Details of what is publicly visible, what is visible to industry users, and what is private to you are set out in our Privacy Policy.

4. Subscription and Trial Period

New adult and child actor registrations begin with a 10-day trial period. A payment is required at registration to activate access to the platform and its features.

During the 10-day trial: if you cancel, your initial payment will be refunded and your full access to Fishpond will end at the conclusion of the 10-day period.

After the 10-day trial: if you do not cancel, your chosen subscription plan continues automatically. For monthly plans, the next payment is taken one month after registration. For annual plans, the remaining annual balance is charged one month after registration and renews annually thereafter unless cancelled.

Fishpond reserves the right to suspend or limit access where subscription payments fail or are declined.

5. Automatic Renewals and Cancellation

All subscriptions renew automatically unless cancelled in advance through your account settings.

You may at any time:

cancel a subscription, restart a cancelled subscription, switch between monthly and annual plans, or update your payment details, all through your Fishpond account.

We may send automated reminder emails before subscription renewals.

Cancelling a subscription prevents future renewals but does not entitle you to a refund for the current subscription period, except during the initial 10-day trial period or where required by law. Nothing in these Terms affects your statutory rights as a consumer.

6. Restarting a Subscription

If you restart a subscription within 90 days of cancellation, your account will reactivate with your existing profile content and you will not be entitled to a new trial period.

If more than 90 days have passed since cancellation, you may be treated as a new registration. Your previous profile content may no longer be available, in line with the retention periods set out in our Privacy Policy.

7. Discounted Membership Plans

Fishpond may offer discounted membership plans, which may include Drama Student or Graduate plans, Senior plans, Disabled plans, and Unwaged plans.

Members applying for a discounted plan may be asked to provide information or documentation to confirm eligibility. We handle these documents in line with our Privacy Policy, where you can find details of who sees them and how long they are kept. They are never publicly visible on the platform.

We reserve the right to request additional proof of eligibility, remove discounted access, or move a member to a standard subscription plan where incorrect or misleading information has been provided.

8. Discretionary Plans and Hardship

Where a member is genuinely unable to afford a discounted plan, Fishpond may, at its discretion, offer further support. We are committed to keeping the platform accessible to actors regardless of financial circumstance. Requests can be made by contacting hello@fishpond.ie.

9. Child Actor Accounts

Child actor profiles must be created and managed by a parent or legal guardian, who is responsible for:

all subscription payments, account activity, profile information, applications and submissions made through the platform, and ensuring all information provided is accurate and age-appropriate.

When a child actor reaches 18, Fishpond may invite the member to transition to an adult account in their own name.

10. Copyright and Uploaded Materials

You are responsible for ensuring you have full copyright clearance and permission to use all photographs, videos, voice clips, showreels, and other content uploaded to your profile or otherwise to the platform.

In the event of a copyright dispute or complaint, Fishpond reserves the right to remove the material temporarily until the matter has been resolved. Repeated or serious breaches of copyright may result in suspension or removal of the account.

11. Agents and Representation

If you have an agent or representative, you are responsible for ensuring they have the appropriate permissions and access required to manage applications, auditions, and self-tapes submitted through the platform on your behalf.

Fishpond may, in future, introduce dedicated functionality for agents and representatives. These features will be governed by these Terms and any additional terms communicated at the time.

12. Casting Opportunities

Your Fishpond subscription entitles you to membership of Fishpond.ie, where we work to present your profile to casting professionals and industry users and to support members in making the most of their profile.

Fishpond cannot guarantee auditions, recalls, representation, employment, or paid acting opportunities. Casting professionals and industry users manage their own casting projects and decisions independently of Fishpond.

13. Member Conduct

You agree not to use Fishpond to:

harass, impersonate, mislead, or behave inappropriately towards other users or industry professionals, spam other users, upload unlawful, offensive, or misleading content, infringe the intellectual property or privacy rights of others, scrape, harvest, or otherwise systematically extract data from the platform, or attempt to gain unauthorised access to the platform or other accounts.

Fishpond reserves the right to suspend or remove accounts in breach of these standards.

14. Additional Terms for Industry Users

These additional terms apply to casting professionals, agents, producers, and other industry users (collectively, “Industry Users”) in addition to the general Terms above.

Use of the platform. Industry Users may use Fishpond to view actor profiles, post casting notices, contact actors regarding genuine casting opportunities, and manage related casting activity. Use of the platform for any other purpose requires our prior written consent.

Use of actor data. Industry Users may not:

download, copy, store, redistribute, or republish actor profiles, photographs, voice clips, videos, or contact information for any purpose other than legitimate casting activity related to a specific project, use actor data to populate competing databases or services, use actor data to train artificial intelligence or synthetic media systems, share actor data with third parties outside the scope of a specific casting project, except where the actor has consented, or contact actors for non-casting purposes.

Casting notices. Industry Users posting casting notices must ensure that notices are accurate, lawful, and reflect genuine casting opportunities. Fishpond reserves the right to remove notices that are misleading, inappropriate, exploitative, or that breach these Terms.

Confidentiality of casting briefs. Industry Users acknowledge that information submitted by actors in response to casting briefs may be confidential and should be handled professionally and in line with industry standards.

Compliance with law. Industry Users are responsible for ensuring their use of the platform complies with applicable law, including intellectual property law, performer rights, data protection law, and employment law.

Breach. Fishpond reserves the right to suspend or remove the accounts of Industry Users who breach these Terms, and to take further action, including legal action, where appropriate.

15. Account Suspension and Termination

Fishpond reserves the right to suspend or remove accounts that:

breach these Terms, contain false or misleading information, misuse the platform or its features, infringe copyright, abuse casting services (including posting fraudulent or misleading casting notices, harassing members, or misrepresenting projects), or fail to maintain subscription payments.

Where reasonable to do so, we will notify the member of the issue and provide an opportunity to address it before suspension or removal. In cases of serious breach, suspension may be immediate.

16. Complaints and Disputes

If you have a complaint about another member, an Industry User, or the platform itself, please contact us at hello@fishpond.ie. We aim to acknowledge complaints within five working days and to respond substantively within fifteen working days where possible.

Complaints relating to data protection may also be referred to our Privacy Contact, as set out in the Privacy Policy.

Fishpond will review all complaints fairly and may take action including issuing warnings, removing content, suspending accounts, or referring matters to relevant authorities where appropriate. We cannot guarantee a specific outcome to any complaint.

17. Changes to Services and Pricing

Fishpond reserves the right to amend subscription pricing, change membership plans, modify platform features, or discontinue services. Reasonable notice will be provided where appropriate, and material changes affecting paying members will be communicated in advance.

18. Limitation of Liability

Fishpond shall not be liable for:

loss of auditions, loss of employment or representation opportunities, technical interruptions or platform unavailability, the actions, conduct, or compliance of third-party users including Industry Users, or any indirect or consequential loss arising from your use of the platform.

Members use Fishpond at their own discretion. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Irish law.

19. Privacy

Fishpond processes personal data in accordance with applicable Irish and EU data protection law, including the GDPR. Please refer to our Privacy Policy for full information on how we collect, use, share, and protect your personal data, including how we approach artificial intelligence and synthetic media.

20. Governing Law and Jurisdiction

These Terms are governed by the laws of Ireland. Any disputes arising in connection with Fishpond.ie are subject to the jurisdiction of the Irish courts.

21. Changes to These Terms

Fishpond reserves the right to update these Terms from time to time. Where changes are material, we will notify members by email or through a notice on the platform before the changes take effect. Your continued use of Fishpond following the effective date of any update constitutes acceptance of the revised Terms.
